You are aware that using our mobile application Resident360 ("App") and website https://resident360app.com ("Website") (together, the "Platform") is subject to a number of terms and conditions (also known as the "Terms of Use" or "Terms").

Before using the Platforms or registering on the App, please carefully read these Terms.

1. Agreement to the Terms & Creation of User Profile

1. Acceptance of Terms

By accessing, installing, or using the Resident 360 application or website (“Platform”), you acknowledge that these Terms & Conditions, together with our Privacy Policy, form a binding agreement between you and the Company. Your continued use of the Platform signifies your complete acceptance of these Terms.

2. Eligibility to Use the Platform

You must be at least 18 years of age to create an account or use any service offered through the Platform. If you are below 18, or below the legal age applicable in your state/country, your parent or legal guardian must review these Terms and agree to them on your behalf before you use the Platform.

3. Authority to Represent an Organisation

  • you have the authority to bind the concerned organization to these Terms

4. Accuracy of Information Provided

You agree to provide accurate, complete, and up-to-date information when creating your account and to update such information promptly. The Company shall not be responsible for issues arising from outdated, incorrect, or incomplete information.

6. Login Credentials and Account Security

You may access your account using a password or OTP. You are solely responsible for maintaining confidentiality of credentials. If you suspect misuse, you must reset your password and inform the Company immediately.

7. Verification and Right to Suspend Accounts

The Company reserves the right to deny registration, suspend, restrict, or permanently terminate accounts if information provided is false, misleading, or incomplete, without prior notice.

8. Personal Use of the Platform

The Platform is intended strictly for personal, lawful, and non-commercial use unless expressly authorized in writing.

9. Consent to Communication

You consent to receive calls, SMS, push notifications, and emails related to your account, services, and alerts.

10. Disclaimer Regarding Security Personnel & Third-Party Providers

Resident360 is a technology platform only. The Company does not recruit, verify, supervise, or monitor any security personnel, housekeeping staff, or third-party service providers. All responsibility rests solely with the respective association or management.

2. Setting Up the Customer’s Account

When an authorised representative of a housing association, resident welfare society, builder, PG, villa owners, or property management entity (“Direct Customer”) creates an administrative account, the Company may require verification and authorization before activating the President Account.

The Direct Customer is solely responsible for safeguarding credentials. All actions, uploads, deletions, and communications made through the President Account shall be deemed actions of the Direct Customer. The Company shall not be liable for misuse or unauthorized access.

3. Scope of Services Provided

Resident 360 offers digital tools for community communication and management, which may include:

  • Resident can register their own and authentication
  • Visitor logs and access management
  • Service request and complaint tracking
  • Notice board and alert messaging
  • Community engagement tools
  • Service provider listings
  • Payments notifications

Resident 360 may modify, update, or discontinue features without prior notice.

4. Customer Assistance & Technical Support

Support is available through in-app help sections, email, or chat. While we strive to resolve issues promptly, we do not guarantee:

  • Error-free support
  • Immediate resolution
  • Continuous availability of help channels

5. Account Suspension, Deactivation, or Closure

Resident 360 may suspend or terminate accounts due to:

  • Violation of these Terms
  • Fraudulent or suspicious activity
  • Misuse of the platform
  • Legal or regulatory requirements
  • Non-cooperation with investigations

Users may request account deletion through support.

6. Data Retention & Information Sharing

Resident 360 may retain user data as required for operational or legal purposes.

We may disclose limited information:

  • If required by law or legal process
  • To protect platform integrity, users, or property
  • To trusted service providers working on behalf of Resident 360

Resident 360 does not sell user data to advertisers or external parties.

7. Security Measures and System Protection

Data Security and Limitation of Liability

Resident 360 implements reasonable, appropriate, and industry-standard technical and organizational security measures, including but not limited to encryption, access restrictions, and secure infrastructure practices, to safeguard user data. Notwithstanding these measures, no electronic transmission, storage system, or digital platform can be guaranteed to be completely secure or free from unauthorized access.

Users acknowledge and accept that they are solely responsible for maintaining the confidentiality and security of their devices, login credentials, and access to the platform. To the maximum extent permitted under applicable law, Resident 360 disclaims all liability for any loss, damage, unauthorized access, data breach, or security incident arising from circumstances beyond its reasonable control, including but not limited to third-party actions, cyberattacks, system failures, or user negligence.

8. External Website & Third-Party Integrations

Our application may include links, integrations, or connections to third-party platforms, services, payment gateways, or external websites for user convenience and extended functionality. These external platforms operate independently and are governed by their own privacy policies, terms of service, and operational procedures.

Resident360 does not control, endorse, or assume responsibility for the accuracy, availability, reliability, or security practices of any third-party services. Users are strongly encouraged to review the applicable third-party policies before engaging with their services.

By using external integrations through the Platform, users acknowledge that any transaction, communication, or interaction with third-party providers is conducted entirely at their own risk.

Resident 360 is only a facilitator between residents, societies, and vendors and is not liable for service quality or disputes.

9. Intellectual Property Rights & Usage Limitations

All content available within the Platform, including but not limited to software code, design elements, logos, trademarks, graphics, text, data, and user interface elements, are the exclusive intellectual property of Aptapace Innovative Technologies Pvt Ltd unless otherwise stated.

Users are strictly prohibited from:

  • Copying, modifying, reproducing, or redistributing platform content
  • Reverse engineering or attempting to extract source code
  • Using platform content for commercial purposes without written consent
  • Replicating platform features, workflows, or business models

Any unauthorized usage may result in legal action and permanent account termination.

10. Restricted Activities & User Responsibilities

Users agree not to engage in any activity that may harm the Platform, other users, or violate applicable laws. Restricted activities include but are not limited to:

  • Posting misleading, false, illegal, or harmful content
  • Attempting to access unauthorized system data or accounts
  • Using automated bots, scraping tools, or malicious software
  • Uploading content that violates intellectual property rights
  • Conducting fraudulent transactions or misrepresenting identity
  • Distributing spam, phishing, or promotional scams

Users are solely responsible for any content, advertisements, or services published through their accounts.

11. Validity of Terms and Conditions for Ending Services

These Terms and Conditions remain valid until the user account is permanently deleted or services are discontinued by the Company.

Resident360 reserves the right to terminate or suspend services without prior notice if:

  • Users violate platform policies
  • Users engage in unlawful or unethical activities
  • System misuse or security threats are detected

Even after service termination, clauses relating to intellectual property, indemnification, liability limitations, and dispute resolution shall continue to remain in effect.

12. Warranty Limitations & Liability Disclaimer

The Platform and its services are provided on an “as-is” and “as-available” basis. While Resident360 strives to maintain accuracy and uninterrupted service, no guarantees are made regarding:

  • Continuous system availability without downtime
  • Error-free or bug-free performance
  • Guaranteed business outcomes or revenue generation
  • Complete protection against external cyber threats

Resident360 shall not be liable for financial losses, data loss, service interruptions, or third-party service failures.

13. User Obligation to Compensate (Indemnification)

Users agree to indemnify and hold harmless the Company, its employees, partners, and service providers against any claims, losses, damages, or legal expenses arising from:

  • Violation of these Terms and Conditions
  • Misuse of platform services
  • Infringement of third-party rights
  • Illegal activities conducted using the Platform

14. Supplementary Policies & Additional Guidelines

These Terms and Conditions operate alongside other platform policies, including but not limited to:

  • Privacy Policy
  • Content Publishing Guidelines
  • Payment and Refund Policies
  • Advertisement and Service Listing Policies
  • Community or User Interaction Rules

In case of conflict, these Terms and Conditions shall prevail unless otherwise stated. Resident360 reserves the right to update policies at any time.

Resident360 services are primarily operated from India and are accessible to users in India, Nepal, and Sri Lanka.

Users accessing services from Nepal and Sri Lanka agree that they are responsible for complying with local laws and regulations. Certain features or payment options may vary based on regional compliance requirements.

The Company reserves the right to restrict, modify, or discontinue services in any region based on legal or operational requirements.
